OFFER TERMS & CONDITIONS

1.        Information on how to enter forms part of these terms of entry.  Entry into the Promotion is deemed acceptance of these terms and conditions.    

2.        The Promoter is Pistachio Papi, VIC 3008 (Anecdote Official PTY LTD T/AS Pistachio Papi, 10 English Street, Essendon Fields). Prize providers include: Krispy Kreme Australia Pty Ltd (Suite B, 90-96 Bourke Street Alexandria NSW 2015 ABN 59 099 478 663) (Krispy Kreme), 7-Eleven Stores Pty Ltd (Building 2/658 Church St Cremorne VIC 3121 ABN 48 005 299 427) (7-Eleven).

3.        Promotion commences on 8 April 2026 at 12:01am AEST and ends on 28 April 2026 at 11:59pm AEST (Promotion Period). No entries will be accepted outside the Promotion Period. 

 

Exclusions of Entry

4.        Employees (and their immediate family members) of the Promoter, Krispy Kreme, 7-Eleven and their franchisees and agencies associated with this Promotion are not eligible to enter. "Immediate family member" means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

    

How to Enter    

5.        Entry is open to all residents of Australia and over the age of 16.

6.        For the purposes of these terms and conditions, an “eligible entrant” is a person who has complied with these terms and conditions.     

7.        To enter, eligible entrants must during the Promotion Period:

i)           have an Instagram Account and ensure their Instagram profile is public;

ii)        follow @pistachiopapiofficial, @7elevenaus and @krispykremeaustralia on Instagram;

iii)      like the Promotion post on any of the 3 accounts and tag a friend.

 

By completing the steps above the entrant will receive one (1) entry into the Promotion.

 

8.        Invalid entries will be excluded from the giveaway. Eligible entrants may enter multiple times provided each entry is submitted separately tagging a different friend, in accordance with the entry instructions above. The entrant is eligible to win a maximum of one (1) prize

9.        No entry fee is charged by the Promoter to enter the Promotion. Where entry is allowed online, there is no additional cost to enter the Promotion other than any cost paid by the entrant to access the website or social media platform of entry via their Internet service provider.

 

10.   By entering the Promotion, eligible entrant:    

(a) agrees to participate in and co-operate as required with all reasonable marketing activities relating to the Promotion and the Prize Pack .    

(b) consent to their name being made publicly available on the Promoter’s social media page; and    

(c) consent to the entry being used by the Promoter in accordance with these terms and conditions (and by Meta for promotion purposes in accordance with Meta’s terms of use).    

(d) winners must reside in Australia

Prizes and judging    

11.   This is a game of chance. Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.

 

12.   The Promoter will randomly select 5 winners. Each winner will receive 1 Krispy Kreme Pistachio Papi Dozen pack of doughnuts , 1 x 7-Eleven Digital VISA Gift Card valued at $200, 1 x Pistachio Papi Apron and 1 jar of Pistachio Papi Spread, total value of $300 per prize (Prize Pack). Total prize pool value is $1,500. The Prize Pack is subject to the following conditions:

(a) The Krispy Kreme Pistachio Papi Dozen prize will be provided as a single-use promotional code redeemable online. The promotional code will be sent to each winner via Instagram direct message by the Promoter. To redeem, the winner must place an order via the Krispy Kreme Australia website at https://www.krispykreme.com.au (Preferred Date Only), add the Pistachio Papi Dozen to basket, proceed to checkout, select delivery or click & collect, and choose a fulfilment date at least 24 hours after the order is placed. The winner must enter the promotional code at checkout to receive the  Pistachio Papi Dozen doughnut pack for free. The promotional code is not valid for same-day delivery or same-day click & collect.  Delivery fee will apply.

(b) The 7-Eleven Digital VISA Gift Card will be provided via a single-use URL and must be saved to your mobile wallet for instore use only at 7-Eleven stores in Australia and where prepaid VISA Gift Cards are accepted and processed electronically . The promotional code will be sent to each winner by Instagram direct message by the Promoter . The 7-Eleven Digital VISA Gift Card is subject to 7-Eleven Digital VISA Gift Card terms and conditions. (c) The Pistachio Papi Apron and Spread will be posted directly to the winner.

13.    A total of 5 winners will receive one (1) Prize Pack each.

The Prize Pack (or any portion of it) cannot be exchanged or redeemed for cash. If a Prize Pack (or portion of it) is unavailable for whatever reason, the Promoter reserves the right to substitute the Prize Pack (or that potion) for a prize of equal or greater value, subject to state regulation.   

Prize draw and winner notification

14.    A random prize draw will take place at 10 am on 30 April 2026 by the Promotor at 10 English Street, Essendon Fields.

15.   The winners will be notified by direct message to their Instagram Account (Direct Message) within one (1) day of the draw.

16.   Prizes must be claimed by 10am on 5 May 2026 by responding and following any instructions in the Direct Message.

(b) In the event of any unclaimed prize or if the winner does not submit the requested information the prize will be forfeited and the prize will be redrawn by the Promoter on 6 May 2026 at 10am. The winner(s) of the redraw will be notified by Direct Message within one (1) day of the redraw.

 

17.   If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner.

18.   The Promoter’s  decision is final, and the Promoter will not enter into correspondence regarding the Promotion result or enforcement and interpretation of these terms and conditions (including any disqualification).  

 

Other

 

19.   The Promoter reserves the right, at any time, and in its sole discretion to (a) request entrants to provide proof of identity and/or proof of valid entry; or (b) disqualify any entrant who the Promoter has reason to believe has breached any of these conditions or engaged in any unlawful or other improper conduct or any conduct calculated to jeopardies the fair and proper conduct of the Promotion.    

20.   If for any reason this Promotion is not capable of running as planned, including but not limited to tampering, weather event, earthquake, terrorism, unauthorised intervention, fraud, any technical difficulties or equipment malfunction or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to take any action that may be available, and to cancel, terminate, modify or suspend the Promotion, subject to state regulation.    

21.   The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any goods or services offered as part of the Promotion.  To the extent permitted by law, the Promoter is not liable for any loss (including indirect and consequential loss) suffered to person or property by reason of any act or omission (including deliberate or negligent acts or omissions) by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods or services by any person to the prize winners and, where applicable to any persons accompanying the prize winners.  This clause does not affect any rights a consumer may have which are unable to be excluded under Australian law.  To the fullest extent permitted by law, any liability of the Promoter or its employees or agents for breach of any such rights is limited to the payment of the costs of having the prize supplied again.    

22.   Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.   

23.   Entry and continued participation in the Promotion is dependent on the entrant following and acting in accordance with the Instagram Terms of Use, (http://instagram.com/legal/terms/). This Promotion adheres to the terms and conditions set out in the Instagram promotion guidelines which can be found at: http://help.instagram.com/179379842258600. Any questions or comments regarding the Promotion must be directed to the Promoter, not to Instagram. The entrant releases Instagram and its associated companies from all liabilities arising in respect of the Promotion. Entrants acknowledge that the Promotion is in no way sponsored, endorsed or administered by, or associated with Instagram.

24.   The value of the Prize Pool is accurate and based upon the recommended retail value of the prizes (exclusive of GST) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the Prize Pool after that date.

 

Privacy    

25.   The Promoter collects the entrant's personal information for the purpose of conducting and promoting this Promotion (including but not limited to determining and notifying the winner) and may disclose the entrants' personal information to third parties including its contractors and agents, prize suppliers and service providers to assist in conducting this Promotion. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion.   

 

26.   By entering the Promotion, unless otherwise advised, each entrant also agrees that the Promoter may use personal information collected to conduct the Promotion, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages.  The Promoter is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth). The Promoter will hold an entrants’ personal information in a secure manner in accordance with the Promoter’s Privacy Policy (a copy of which can be found on  https://pistachiopapi.com.au/policies/privacy-policy).  The Promoter's privacy policy contains information about how the entrant may access, update and seek correction of the personal information the Promoter holds about them and how the entrant may complain about any potential breach by the Promoter of the Australian Privacy Principles or any other Australian privacy laws and how such complaints will be dealt with.
